CLINTON & CLINTON ATTORNEY, TODD AUSTIN, OBTAINS DEFENSE VERDICT IN PREMISES LIABILITY CASE

Trial attorney Todd Austin of Clinton & Clinton obtained a defense verdict for its client, which was sued by an elderly man who sustained a head injury in a bizarre accident involving a flight of stairs. Plaintiff visited Defendant's property for purposes of inspecting it as a potential investment. While walking down the stairs from the second floor to the first floor, Plaintiff lost his balance because of an alleged lack of a handrail. Plaintiff claimed that he flew down the stairs out of control. His momentum carried him outside, where he struck his head on a post. Plaintiff sought to recover $1,200,000 for past medical specials and for past and future general damages. Defendant offered evidence that a handrail was always present and that the staircase was not dangerous. Additionally, Mr. Austin called into question the credibility of Plaintiff, who could not remember much about the accident because of his head injury. Mr. Austin also successfully and repeatedly impeached Plaintiff's key witness. After a four day bench trial the Court returned a verdict for Clinton & Clinton's client, noting that Plaintiff and his witness were not credible and therefore Plaintiff failed to meet his burden of proof.
